Terms of Use for Yandex Maps Specific Services

These Terms of Use for Yandex Maps Specific Services (hereinafter referred to as the "Agreement") constitute an offer by YANDEX LLC (hereinafter referred to as "Yandex") to an Internet user (hereinafter referred to as the "User") to use services interacting with "Yandex Maps" on the terms set forth below.

1. Terms and Definitions

1.1. For the purposes of these Terms, the following terms shall have the meanings set forth below:

  • API — Application Programming Interface;
  • API Geosuggest — A server-side API Service designed for automated retrieval of search suggestions when searching for geographical objects and/or organizations;
  • Developer's Account API — A Service representing a programming interface that allows obtaining information on limits, connected Yandex services, and the balance on the Personal Account using an existing key;
  • Organization Search API — A server-side API Service designed for automated retrieval of information about Organizations;
  • API Key — A unique identifier issued to the User, enabling access to the functions of the API Services from their website or mobile application;
  • HTTP API Geocoder — A server-side API Service providing access to the HTTP geocoding function;
  • HTTP Geocoding — A function of the HTTP API Geocoder that converts object addresses into their coordinates and, conversely, converts coordinates into object addresses;
  • JavaScript API Yandex.Maps including Panorama Player — An API Service (software library) providing the ability to work with the "Yandex Maps" service in a browser, which includes the functions of Panorama Display;
  • Mobile SDK MapKit — A Service - a set of development tools, providing the ability to work with the Yandex Maps service in mobile applications for iOS and Android operating systems;
  • Static API — A server-side API Service providing the ability to obtain Data from the "Yandex.Maps" service in the form of a static image;
  • Tiles API — A server-side API Service, the functional purpose of which is to obtain specific sections of the image of Yandex Maps Tiles;
  • API Key Activation — The provision by Yandex of the possibility to use the Services within the limits stipulated by the Agreement;
  • Reviews Widget — A Service-function providing the ability to place an information block (widget) on the User's Internet resource page containing information about the organization's rating and reviews displayed in the organization's card in the "Yandex Business" service in accordance with the Terms of Use of the Yandex Business service (https://yandex.ru/legal/clients_termsofuse);
  • Yandex Maps Widget — A Service-tool that allows integrating an interactive map on a web page;
  • Geocoder — A server-side API Service, the functional purpose of which is to determine coordinates and obtain information about an object by its name or address, as well as to determine the address of an object on the map by its coordinates (reverse geocoding);
  • Geo-link — A Service that allows highlighting a specific address or organization name on an Internet resource page so that clicking on it opens a map with the object's location;
  • Data — Information received from the Services, intended for display to Users, including but not limited to, cartographic works, satellite images, photographs, and other data;
  • Personal Account Data — Information received from the Service, intended for display to Users, including but not limited to, user data, connected "API" Services, available limits under tariffs, current balance on the Personal Account;
  • Statistics Data — Data from Yandex's automated information accounting systems in electronic form, which may include, among other things, information about the number of Requests, the amount of remuneration (if applicable), and other information related to the use of the Services;
  • Documentation — Technical and other documentation of the Services, which is available on the Yandex Internet resources specified in the Agreement, and which may be provided to the User before the start and/or during the use of the Services. The provisions and requirements set forth in the Documentation are binding on the User;
  • Request — An appeal to the functions of the Service;
  • Developer's Account — A section of the Yandex website located on the Internet at https://developer.tech.yandex.ru or https://developer.tech.yandex.kz, https://yandex.ru/legal/maps_api/components, which contains Statistics Data on the use of API Services, and also provides the possibility of remote interaction between the Parties within the framework of the Agreement, including the possibility of remote receipt of API keys, accessible to the User after authorization on the Yandex website (https://passport.yandex.ru), the features of use of which are posted on the Internet at https://yandex.ru/dev/developer-help/doc/ru/;
  • Map Constructor — A Service-tool that provides the ability to create an interactive and/or static map with User's objects;
  • Personal Account — A personal account in the Developer's Account;
  • Organizations — Legal entities, individual entrepreneurs, enterprises, information about which (including location address, working hours, work phone, but not limited to the above) is possessed by Yandex;
  • Offer — The document "Offer for Conclusion of a License Agreement for Granting the Right to Use the Software," posted on the Internet at https://yandex.ru/legal/maps_api_offer or https://yandex.kz/legal/maps_api_offer for Users - Residents of the Republic of Kazakhstan;
  • Panorama Display — A function of the "JavaScript API Yandex.Maps including Panorama Player" Service and Mobile SDK MapKit, the purpose of which is to display spherical panoramas on website pages and/or applications. Panorama Display allows displaying both panoramas of the Rightholder and the user's own spherical panoramas;
  • Rightholders — Persons who lawfully hold rights to the Data;
  • Services — A set of tools, function development tools, and programming interfaces that enable interaction with the "Yandex Maps" service and the "Yandex People's Map" service, including with the Data of these services, and the possibility to use the functionality of the said services on the User's website(s) or applications on a non-commercial basis;
  • Tiles — Images of the same size into which the full map image is divided, obtained from the Yandex Maps service using the Tiles API;
  • Test Period — The possibility to use the commercial version of Yandex services and software without charging a fee for the purpose of familiarization with the functionality of such services within the established restrictions on the term and volume of use.

1.2. Terms not defined in clause 1.1 of the Agreement may be used in the Agreement. In this case, such a term shall be interpreted in accordance with the text of the Agreement. In the absence of an unambiguous interpretation of the term in the text of the Agreement, one should be guided by the interpretation of the term established on the Internet.

2. General Provisions

2.1. The User's use of the Services is governed by this Agreement, as well as by:

(Hereinafter collectively referred to as the "Governing Documents").

The User undertakes to review all Governing Documents and independently bears the risk of failure to do so.

2.2. This Agreement and the relations between Yandex and the User arising in connection with the use of the Services shall be governed by the legislation of the Russian Federation.

2.3. The User is solely responsible for compliance with the Legislation when using the Services. Throughout the text of this Agreement, unless expressly stated otherwise, the term "Legislation" refers to both the legislation of the Russian Federation and the legislation of the User's place of residence or place of performance of legally significant actions under this Agreement. If the User's use of any feature provided by the Services violates the legislation of the User's place of residence, the User undertakes to refrain from using the Services.

2.4. By using the Services, including by obtaining an API Key and placing the code of the corresponding Service on the User's website or in the User's application (provided that the HTTP Referer header is transmitted, allowing unambiguous identification of the User's website or application; for mobile applications, the Referer must be transmitted in the form of http://application_identifier_in_store.ymapapp), or by using any other functionality of the Services, the User expresses its full and unconditional consent to all terms of the Governing Documents and undertakes to comply with them. Use of the Services on terms other than those specified in this Agreement is possible only upon written agreement with Yandex, as well as on the terms of using the Services on a commercial basis. In case of disagreement with the terms of the Governing Documents, the User has no right to use the Services.

3. Conditions for Granting Access to the Services

3.1. The User may obtain access to the Services under this Agreement only if the following conditions are met:

3.1.1. To use the Services JavaScript API Yandex Maps including Panorama Player, Geocoder, Mobile SDK MapKit, Static API, API Geosuggest, Tiles API, the User must register in the Developer's Account and obtain an API Key. Use of the specified Services without an API Key is prohibited.

3.1.2. To gain access to the API of the Developer's Account, the User must register using the established form and obtain an API Key.

3.1.3. After receiving the API Key, the User needs to place the Service call code on the website or in the application, indicating the API Key.

3.1.4. To access the commercial versions of Yandex Maps services or Yandex software for the purpose of familiarization with their functional capabilities, the User has the right to request a Test Period. In this case, the terms of use of such services and software during the Test Period shall be governed by the Offer. The User is aware and agrees that upon starting to use Yandex services and software within the granted Test Period, they understand and accept the terms of the Offer.

3.1.5. Access to other Services is carried out in accordance with the Documentation.

3.2. Yandex has the right, at its sole discretion, to deny access to the Services or the provision of a Test Period without stating reasons. The User has no right to use any programs, devices, or other means that allow obtaining an API Key automatically or otherwise in violation of the procedure established by Yandex.

4. Terms of Use of the Services

4.1. Use of the Services under this Agreement is permitted only if the following conditions are met:

4.1.1. Unless otherwise expressly provided by these terms, the Services may be used by the User only within the framework of websites or applications available for free open use by an unlimited number of persons. The Services may not be used in projects requiring payment or otherwise restricting third-party access to them. The need to register in a project is not considered a restriction of access within the framework of this clause; however, the presence of special requirements for registration in a project that differ from the requirements applied in similar projects and/or go beyond technical necessity will be considered a restriction of access to the project. For the avoidance of doubt, the requirement to provide identity document data for registration in a project is considered a condition restricting third-party access to the project.

4.1.2. The User may use the Data, Personal Account Data, functions, and tools obtained using the Services only within the functionality provided by the Services.

4.1.3. The User undertakes to reference Yandex as the rightholder of the Services:

4.1.3.1. The User undertakes not to move, hide, modify, or overlay with other elements the "open in Maps" button, as well as the link to the Terms of Use of the Yandex.Maps service: https://yandex.ru/legal/maps_termsofuse or https://yandex.kz/legal/maps_termsofuse for Users - Residents of the Republic of Kazakhstan, copyrights, and the Yandex logo on the map.

4.1.3.2. The User undertakes to place in its mobile application in the "About the Program" section or another similar section of the mobile application, a hyperlink to the Terms of Use of the Yandex.Maps service, posted at: https://yandex.ru/legal/maps_termsofuse or https://yandex.kz/legal/maps_termsofuse for Users - Residents of the Republic of Kazakhstan, as follows - "Terms of Use of the Yandex.Maps service".

4.1.3.3 The User undertakes to display the "Open in Maps" button on the screen when using the Services.

4.2. If the User's website or application has a daily audience of more than 100,000 users, the User, before starting to use the Services, is obliged to contact Yandex by sending an email to maps-api@support.yandex.ru, in which it must specify the name of the website or application and the daily audience of users. These actions are necessary to ensure the performance of such User's websites or applications.

4.3. The User acknowledges that for the purposes of the Agreement, in particular, to determine the number of Requests, the amount of remuneration (if applicable), as well as to determine the moment of granting the right to use the Services by the User and the commencement of the term of use of the Services, exclusively Yandex's Statistics Data are used.

4.4. The User of the Services listed in clause 6 must use the latest version of the Service update.

4.5. Yandex has the right to set the maximum number of requests to the Services. If the maximum number of requests to the Services is exceeded, Yandex reserves the right to suspend access to the API.

4.6. Yandex has the right to temporarily suspend access to the Services for technical, technological, or other reasons preventing such provision, for the period of elimination of such reasons.

4.7. Yandex reserves the right to include advertising materials at its discretion in the Data provided and displayed by the Services.

5. General Restrictions on the Use of the Services

5.1. When using the Service, the User is prohibited from:

5.1.1. Modifying, decompiling, and/or in any way modifying the program code obtained through the Services.

5.1.2. Deleting, changing the order or sorting, hiding, or modifying the Data, as well as any information contained in the Services or Data, including but not limited to, advertising and informational materials, trademarks, logos, links, or other indications of Rightholders, as well as any other notices and/or information transmitted by the Services together with the Data.

5.1.3. Creating, based on the Services, systems for monitoring vehicles, people, or other objects, displaying information in real time, and any other services related to management and dispatching. The use of Data for the purposes specified in this clause is possible only under commercial tariffs of the Yandex Maps API on the terms set forth in the Offer.

5.1.4. Creating, based on the Services, computer programs or other services, the functional and intended purpose of which is similar or analogous to the "Yandex Maps" service or the "Yandex Maps" program for mobile devices and other Yandex services.

5.1.4. Using more than one account in the Developer's Account to use the same Service in order to circumvent the established restrictions and limits of use of such Service.

5.1.5. Storing, processing, and modifying the Data obtained through the Services, Personal Account Data (including the results of the Services' responses), except for cases of temporary storage (caching) of response results to requests solely for the purpose of improving the functionality and performance of the Services and only for use within the capabilities provided by the Services, for a period not exceeding 30 days.

5.1.6. Using the Services to create websites/applications that violate the Legislation or other applicable legislation, the rights and legitimate interests of third parties, as well as contradict the requirements of the Governing Documents and Documentation.

6. Restrictions on the Use of Specific Services

6.1. JavaScript API Yandex Maps including Panorama Player:

6.1.1. Panorama Display may be used only on websites or in applications using the JavaScript API Yandex Maps including Panorama Player Service. The User is prohibited from performing Panorama Display in third-party services or on third-party cartographic materials.

6.1.2. Under this Agreement, the following limits are set for the User:

  • The number of requests to Panorama Display must not exceed 100 (One Hundred) Requests per day.

Use of the Services exceeding the Request limits is permitted only on a commercial basis under the terms of the Offer and tariffs located at: https://yandex.ru/dev/tariffs/doc/ru/jsapi/prices or https://yandex.kz/dev/tariffs/doc/ru/jsapi/prices for Users - Residents of the Republic of Kazakhstan.

6.2. Mobile SDK MapKit:

6.2.1. The User may use the Routing function only in applications using the Mobile SDK MapKit Service. The User is prohibited from displaying the results of the Routing function in third-party services and/or applications or on third-party cartographic materials.

6.2.2. Panorama Display may be used only in applications using the Mobile SDK MapKit Service. The User is prohibited from performing Panorama Display in third-party services and/or applications or on third-party cartographic materials.

6.2.3. Under this Agreement, the following limits are set for the User:

  • The number of unique users visiting applications where the functions of the Service are implemented/embedded/displayed or otherwise available must not exceed 1,000 (One Thousand) users per day.

Use of the Service exceeding the established limit of unique users is permitted only on a commercial basis under the terms of the Offer and tariffs located at: https://yandex.ru/dev/tariffs/doc/ru/mapkit/prices or https://yandex.kz/dev/tariffs/doc/ru/mapkit/prices for Users - Residents of the Republic of Kazakhstan.

6.3. Static API:

6.3.1. Under this Agreement, the following limits are set for the User:

  • The number of requests to the Static API must not exceed 1,000 (One Thousand) Requests per day.

Use of the Service exceeding the Request limits is permitted only on a commercial basis under the terms of the Offer and tariffs located at: https://yandex.ru/dev/tariffs/doc/ru/staticapi/prices.

6.4. API Geosuggest:

6.4.1. Under this Agreement, the following limits are set for the User:

  • The number of requests to the API Geosuggest must not exceed 1,000 (One Thousand) Requests per day.

Use of the Service exceeding the Request limits is permitted only on a commercial basis under the terms of the Offer and tariffs located at: https://yandex.ru/dev/tariffs/doc/ru/geosuggest/prices or https://yandex.kz/dev/tariffs/doc/ru/geosuggest/prices for Users - Residents of the Republic of Kazakhstan.

6.5. Tiles API:

6.5.1. The User has the right to use the Service for its functional purpose, both for commercial and non-commercial use, in open and closed systems, to obtain Tiles and their further display on the User's website/application and other web resources, with the right to place their own data against the background of the specified image, and to make the obtained image publicly available.

6.5.2. Under this Agreement, the following limits are set for the User:

  • The number of requests to HTTP Tiles must not exceed 30 Requests per second (rps).
  • One request to HTTP Tiles is equated to one Request. The Service reserves the right to regulate the rps limit, depending on the total load of all Users.

Use of the Service exceeding the Request limits per second is permitted only on a commercial basis. To coordinate the terms, it is necessary to send a request to paid-api-maps@yandex-team.ru. The request must contain the following information:

  • Full name (for individual entrepreneurs or self-employed)/name of the organization;
  • Purpose of using the Service;
  • Reasons why the free access is not suitable;
  • What limits on Requests per second are required.

6.6. Geocoder

6.6.1. The User may use the Geocoder only on websites or in applications using the JavaScript API Yandex Maps including Panorama Player Service. The User has the right to process the obtained coordinates using the Geocoder solely for displaying them through the "JavaScript API Yandex Maps including Panorama Player" Service. The User is prohibited from displaying the results of the Geocoder's work in third-party services or on third-party cartographic materials.

6.6.2. Under this Agreement, the following limits are set for the User:

  • The total number of requests to the Geocoder must not exceed 1,000 (One Thousand) Requests per day.

Use of the Service exceeding the Request limits is permitted only on a commercial basis under the terms of the Offer and tariffs located at: https://yandex.ru/dev/tariffs/doc/ru/geocoder/prices/ or https://yandex.kz/dev/tariffs/doc/kk/geocoder/prices/ for Users - Residents of the Republic of Kazakhstan.

6.7. In case of violation of the terms of use and/or exceeding the limits of the Services established in this Section 6, Yandex has the right to suspend or block the User's access to the Services without prior notice, including by blocking the API key issued to the User, and/or IP address, and/or HTTP referer. Unless otherwise agreed by Yandex, in case of blocking the User's access to the Services on the grounds set forth in this clause, the restoration of access to the Services can be carried out only under the terms of the Offer or a separate agreement concluded between Yandex and the User.

7. Intellectual Property

7.1. The exclusive right to the Services belongs to Yandex. The exclusive rights to the Data (including cartographic data, images, advertising materials, any trademarks, logos, or trade names), Personal Account Data belong to Yandex or the Rightholders. This Agreement does not grant the User any rights to use the Services or Data beyond those capabilities that are provided directly in the interface of the Services in accordance with this Agreement.

7.2. By using the Services, the User grants Yandex the right to use the logo, trademark, and/or trade name of the User and/or the User's website/application for informational, advertising, and marketing purposes related to the Yandex Maps, Yandex People's Map services, in particular, without the need to obtain additional consent from the User and without paying any remuneration to the User for such use.

7.3. The User transfers to Yandex the right to use information and objects (route schemes, objects on the map, etc.) that the User independently placed using the Map Constructor, by any means in full. The information and objects placed by the User using the Map Constructor may be used on other Yandex services and resources, as well as, with Yandex's consent, on third-party resources. If the User is not entitled to grant Yandex the right to use any information or objects in such a manner, it is not entitled to place them when using the Map Constructor. The rights to the database, which is a collection of information and objects created using any of the Services, belong to Yandex.

8. User Information and Personal Data

8.1. When the User uses the Services, depending on the functionality of the corresponding Service, Yandex may automatically collect, store, and process the following information: IP address and device ID of visitors to the User's websites or applications, geolocation information of visitors to the User's websites or applications. The User guarantees that it has obtained the appropriate consents from visitors to the User's websites or applications for the collection, transfer, and storage of the specified information on Yandex's servers.

8.2. The User's personal information is processed for the purposes of providing the Service and other purposes under the terms of the Privacy Policy (https://yandex.ru/legal/confidential or https://yandex.kz/legal/confidential for Users - Residents of the Republic of Kazakhstan), as well as in accordance with the terms of use of the specific Service.

8.3. The User, if provided for by applicable law, hereby gives its consent to the processing of its Personal Information by Yandex and its affiliated companies for the purpose of providing the User with the functional capabilities of the Services in accordance with these Terms, as well as the provisions of the Offers and Governing Documents.

When the User interacts with the Services, in addition to the information specified in clause 8.1 of the Terms, other information about the User may be subject to processing, including its email address, login, and other data provided by the User during the use of the Services.

This consent is valid during the period of use of the Services and for 10 years after the termination of the use of the Services. This consent may be withdrawn by the User by sending a corresponding letter to the email address maps-api@support.yandex.ru. Upon achieving the purposes of collecting and processing the User's Personal Information and eliminating the need for their storage, this data shall be destroyed.

The User expresses its consent that Personal Information may be transferred by Yandex to other countries. The User's Personal Information shall not be placed in publicly available sources, unless separate consent of the User is provided for this.

9. Liability

9.1. The Services (including the Data and other information provided with its help) are provided by Yandex "as is". Yandex does not guarantee that the Services and Data will meet the purposes and expectations of the Users, the uninterrupted and error-free operation of the Services as a whole and their individual components and/or functions, nor does it guarantee the reliability, accuracy, completeness, and timeliness of the Data obtained using the Services. Yandex is not liable and does not compensate for any losses, including any damage, direct or indirect, caused to the User of the Services or third parties as a result of the use or inability to use the Services, their individual components and/or functions, as well as as a result of the use or inability to use the Data obtained using the Services. Yandex is not responsible for the content of the information provided by the Yandex Business service, its compliance with the Legislation, completeness, correctness, and reliability. Yandex is not responsible for the User's placement (including in bad faith) of information that is inconsistent with reality, outdated, violates the rights and legitimate interests of third parties, and does not confirm or deny the compliance with the Legislation, correctness, and reliability of the information provided by the Yandex Business service.

9.2. The User is solely and fully responsible for the use and safekeeping of its API Key. The User has no right to obtain an API Key for third parties, transfer or provide it to third parties. Yandex is not responsible for unauthorized use of the API Key by third parties. All actions performed on the Services using the User's API Key are considered performed by the User.

9.3. The User must independently assess the reliability, accuracy, completeness, or usefulness of the Data and independently bears all risks associated with the use (inability to use) of the Services and Data, as well as liability to third parties for its actions when using the Services and Data, including for ensuring that the actions comply with the requirements of the Legislation and do not violate the rights and legitimate interests of third parties. The User undertakes, independently and at its own expense, to settle all claims and/or lawsuits of third parties related to the User's actions when using the Services.

9.4. The User understands and agrees that the use, indication, or placement in the Services of any information about any organizations, enterprises, persons, goods, services, including designations and/or links as part of the Data and Services, is solely for informational purposes and does not constitute an expression of their special support, approval, or recommendation by Yandex.

9.5. In case of violation by the User of the requirements of this Agreement and the Governing Documents, Yandex has the right to terminate or suspend the User's access to the Services or their individual functions using its account and/or API key.

10. Final Provisions

10.1. Yandex has the right, at its sole discretion, to terminate or suspend the User's access to the Services or its individual functions using its account and/or API key without stating reasons.

10.2. All questions and claims related to the use/inability to use the Services should be sent to: maps-api@support.yandex.ru.

10.3. Yandex has the right at any time, without notifying the User, to change the text of this Agreement, the Governing Documents, and/or any other terms of use of the Services. The current version of this Agreement is posted at: https://yandex.ru/legal/maps_api. The risk of failure to familiarize oneself with the new version of the Agreement, Governing Documents, and Documentation is borne by the User; continued use of the Services after changes to the terms of the Agreement and/or Governing Documents is considered consent to their new version.

10.4. Yandex reserves the right to change/correct or update the Services at any time, without prior notice to Users. When releasing the next stable version, Yandex announces its release on its website. After the release of a new version, Yandex does not guarantee the stability and duration of the outdated version's operation. The User, who does not agree to use the updated version of the Services, bears the possible risks of using the outdated version of the Services, or may stop using the Services by deleting the corresponding code from the User's website(s)/application.

11. Information on Rightholders and Information Holders

11.1. Current information on rightholders and information holders is available at: https://yandex.ru/legal/right_holders or https://yandex.kz/legal/right_holders for Users - Residents of the Republic of Kazakhstan.

11.2. MapKit includes third-party software as its separate components. Current information on such third-party software within MapKit is available at: https://yandex.ru/legal/maps_api/components.
