Terms of Use of Shedevrum

1. General Provisions

1.1. Yandex, LLC, (the “Yandex”) offers an Internet user (the “User”) to use the Shedevrum service available at: shedevrum.ru, shedevrum.com, shedevrum.ai (the “Service”) and through mobile applications that include its function.

1.2. In all matters not covered by these Terms, the relations between the Yandex and the User in using the Service shall be governed by:

1.3. By starting to use the Service, the User shall be deemed to have accepted these Terms and terms of all of the above documents, in full, without any reservations or exceptions. If the User disagrees with any of the provisions of the said documents, the User may not use the Service.

1.4. Yandex may amend these Terms without any special notice; revised Terms shall take effect once posted online at the URL specified in this clause, unless otherwise provided for in such revised Terms. The Terms in force are always available at: https://yandex.ru/legal/shedevrum_termsofuse/lang=en

1.5. If Yandex has made any amendments to these Terms as prescribed by Cl. 1.4 of these Terms and the User disagrees with these amendments, the User shall stop using the Service.

1.6. By using the Service, the User gives their consent to receive informative messages. The User may unsubscribe from these messages by using relevant functions of the Service or following instructions specified in a message received.

2. Use of the Service. Certain Functions of the Service

2.1. The full functionality of the Service shall be provided to Users who have been authorized using a Yandex ID account. The terms of registration and use of the Yandex ID account are set forth by the Terms of Use of Yandex ID available online at https://yandex.ru/legal/id_termsofuse/en.

2.2. For Users authorised in accordance with the clause 2.1. of the Terms, the Service creates a personal containing information about the User and materials published by the User in accordance with clause 2.3. of the Terms (hereinafter - the "Personal Page").

The User may add and/or change information on their Personal Page, including name, nickname and image (hereinafter - "User Information").

2.3. The Service provide the User with the ability to obtain images (the “Images”) and texts (the “Texts”) using artificial intelligence technology based on a User’s text request (the “Prompt”). The User may also be provided with the possibility to create short videos obtained by the User's selection of an animation effect for the Image (hereinafter referred to as "Video").

At their discretion, the User may publish the received Images, Videos and Texts on the Service, in the public domain, as well as delete Images, Videos and Texts published earlier.

When publishing Texts, the User may be offered to create an Image as a cover for the Text or choose it from the Images generated by other Users and previously posted on the Service.

When publishing Images, Texts or Videos, the User may also add a text label ("Tag") to them, either by entering it manually or by selecting from the available options.

2.3.1. the User is provided with the opportunity to create and publish Images on the Service by uploading a photo or picture from the User's device and modifying them using the Request and the filter mode offered by the Service.

The User understands and agrees that when the User publishes the Images received in accordance with this clause, the Service displays both the Image itself and the original photo or picture uploaded by the User.

The User is prohibited from uploading to the Service photos and/or images containing information about the state of health, intimate life and other information relating to special categories of personal data defined in Article 10 of the Federal Law of 27.07.2006 N 152-FZ "On Personal Data".

2.4. The User agrees that the Images, Videos and Texts published by them on the Service will be accompanied by User information, and information on the Prompt based on which the Image, Video or Text was received, as well as Tags created or selected by the User.

2.5. When using the Service, the User shall be prohibited from using the following information and materials in the User information, Prompt and Tags, as well as creating and publishing as part of the Images, Videos and Texts the information and materials:

2.5.1. which are illegal and/or prohibited for distribution in accordance with the applicable legislation;

2.5.2. containing slander or insults against any persons or organizations, inciting ethnic discord, propagandizing hatred and/or discrimination of people on racial, ethnic, sexual, religious, social and other grounds;

2.5.3. containing obscene language;

2.5.4. shocking and abhorrent, as well as demonstrating violence and cruelty, including the description and visualization of murders, physical mutilation, self-harm, suicide, torture, rape, sacrifice, the consequences of disasters and accidents, wars and hostilities, animal cruelty;

2.5.5. pornographic and/or erotic materials, including those involving minors;

2.5.6. showing or describing the creation of weapons and explosives, or the creation, use or other use of drugs;

2.5.7. infringing copyrights, trademark rights, means of individualization and/or rights to other intellectual property belonging to third parties;

2.5.8. containing advertisements, including information about goods and services of the User and/or third parties, as well as links to commercial websites, accounts and communities in social networks;

2.5.9. containing images and/or personal data of third parties used without the consent of such persons.

2.6. The Service gives the Users an opportunity to follow publications of other Users by means of function "Subscribe". All Images, Videos and Texts published by the tracked Users are displayed in the "Subscriptions" feed.

Information about subscribers and subscriptions of the User is displayed on his/her personal page on the Service.

2.7. The Service also provides Users with an opportunity to publish comments (hereinafter - Comments) under Images, Videos and Texts of other Users.

The provisions of paragraphs 2.4., 2.5., 3.2. of these Terms apply to the publication of Comments.

Users have the right to delete Comments under the Images, Videos and Texts published by them at their discretion.

2.8. Yandex reserves the right, at its sole discretion, to delete any Image, Video, Text, Tag, or User information Comment published by the User on the Service, as well as to restrict the User's access to the Service (or to certain functions of the Service, if it is technologically possible) or completely block the User's account in case of violation of these Terms and other documents specified in Cl. 1.2 of the Terms, or apply other measures to the User to comply with legal requirements or protect the rights and legitimate interests of third parties.

2.9. The User is not entitled to perform actions aimed at circumventing the restrictions set by the Service, including actions aimed at increasing the number of views of Images, Videos, Texts and User Submissions, including but not limited to the use of any automatic methods of reproducing impressions and clicks, use of sensational text in the Request, Tags, Comments aimed at attracting multiple clicks.

2.10. The User may not perform actions aimed at collecting any monetary donations using the Service without prior approval of Yandex.

2.11. The Service provides Users with the opportunity to track the activity of other Users on the Service using the Add to Friends feature. When adding other Users to Friends, the User gets the opportunity to track Images, Videos, and Texts posted by Users added to Friends (hereinafter referred to as Friends), as well as the activity of Friends on the Service, including Comments and Likes posted by them.

By adding other Users to "Friends", the User agrees to share with them information about their activity on the Service, including published Comments and likes. If desired, the User can prohibit the transfer of such information to one or more Friends by changing the settings in the Service interface.

Information about the User's "Friends" is displayed on his Personal Page. Optionally, the User can hide the display of information about Friends for other Users.

2.12. The Service provides the User with the opportunity to use the Janus Pro 7B generative model, distributed under the DeepSeek License Agreement (https://github.com/deepseek-ai/Janus/blob/main/LICENSE-MODEL).

2.13. Users may be provided with additional opportunities to use the Service as part of a paid subscription “Shedevrum Pro”. The subscription cost, its content and restrictions on use, as well as the terms and conditions of subscription provision are governed by the Yandex Plus Subscription Terms and Conditions (https://yandex.ru/legal/yandex_plus_conditions) and the terms and conditions of Additional Options (https://yandex.ru/legal/yandex_plus_opzii_list).

3. Use of generated materials. Intellectual Property Rights

3.1. All rights to the Service, including the software, design and its individual elements, as well as the artificial intelligence technology used therein, belong to Yandex.

3.2. By placing the Prompt or a self-created Tag on the Service, the User grants Yandex and other users of the Service a gratuitous and irrevocable non-exclusive license to use the Prompt or the Tag throughout the world for the duration of the exclusive rights, including, but not limited to, reproduction, copying, selection, systematization, transformation, modification, editing, translation, publication, distribution, broadcasting, cable communication, publicizing the Prompt or the Tag (in part or in full) by any legal means, both with and without specifying the User name, with the right to grant a sublicense to third parties.

By posting a photo or picture on the Service to create an Image in accordance with clause 2.3.1. of the Terms and Conditions, the User grants Yandex a gratuitous and irrevocable non-exclusive license to use the said photo and/or picture (in part or in full) by any lawful means on the territory of the whole world for the term of validity of the exclusive rights with the right to grant a sub-license to third parties.

The User confirms that he/she has the appropriate rights and powers to grant Yandex the license provided by this clause.

3.3. The User has the right to use Images, Videos and Texts created by them or other Users via the Service for personal, noncommercial purposes, subject to paragraphs 2.5. and 3.6. of the Terms and applicable law. Any commercial use of Images, Videos and/or Texts is possible only with prior agreement with Yandex.

You can apply for consent to the commercial use of the Images, Videos and/or Texts via the form.

The User agrees that the Images they publish may be used by other Users of the Service as covers for the Texts published on the Service.

The User also agrees that the Images, Videos and Texts published by them may be used by Yandex in any way and for any purpose, including, but not limited to, for posting on the Service, as well as in other Yandex services, as part of materials for improving the operation of the artificial intelligence technology of the Service and other Yandex technologies, in advertising and marketing materials to attract attention to the Service or other Yandex services, as well as on other resources and channels and pages owned by Yandex.

3.4. The Service creates Images, Videos and Texts automatically, based on open data, therefore, the created Images, Videos and Texts may not have uniqueness and match completely or partially with the Images, Videos or Texts created at the Request of other Users.

By publishing Image, Video or Text on the Service, as well as using already published Images, Videos or Texts, the User assumes all risks, including those pertaining to the violation of exclusive rights of third parties, if they do not comply with the guarantees specified in clause 2.5. of the Terms.

3.5. When starting to use the Service, the User guarantees that no actions are and will be performed to bypass the security features designed to protect against the unauthorized use of the Service. Any copying, reproduction, processing, dissemination, publication, bypassing security features, or other use of the Service and/or its parts, Images, Videos and/or Texts beyond the functions provided by the Service as well as any commercial use shall be prohibited without prior consent of Yandex.

3.6 It is forbidden to use the Service and/or its elements, as well as the Images, Videos and Texts obtained with its use, for the purposes of testing or training models operating with the use of artificial intelligence technology.

4. Miscellaneous

4.1. The Service is provided “as is”. Yandex provides no warranties of fitness of the Service for purposes and expectations of the User, safety of data provided and placed by the Used in the Service, of trouble- and error-free operation of the Service in general and its certain functions, Yandex may, in particular, change functions the Service provides, fully or partially, at any time.

4.2. Yandex shall not be liable for the content of Images, Videos and Texts and for accuracy, relevance, correctness of information received by the User through the Service.

Under no circumstance shall the contents of the Images, Videos and/or Texts be considered as Yandex's position, guidance or advice in making decisions or taking any action.

If the content of the published User information Images, Videos, Texts, Tags or Prompts, in the User’s opinion, violates the requirements of the laws and/or affects the rights and interests of third parties, they may send a claim using the feedback forms on the Service, or send an email to: shedevrum@support.yandex.ru.

4.3. Use of the Service by minors is not permitted. By accepting these Terms, the User confirms that they are at least 18 years old and/or have full legal capacity and all the necessary rights to accept the Terms and use the Service.

4.4. User Data, including User information, received when the Service is being used thereby shall be processed subject to the conditions outlined in the Privacy Policy which is available at: https://yandex.ru/legal/confidential.

4.5. The relationship between the User and Yandex regarding the provision of the Service by Yandex shall be governed by the legislation of the Russian Federation. In case of questions, statements or claims, the User may report them through the functionality of the Yandex Service. In case Yandex and the User fail to reach agreement, the issue may be resolved in court at the location of Yandex.
