Yandex Plus Subscription Terms and Conditions

Terms and Definitions

Yandex Plus Subscription shall mean the provision of the User with the opportunity to obtain remote access to the Content of audio and audiovisual works for viewing and/or listening through the Internet (hereinafter referred to as the "Content"), which description is provided at https://yandex.ru/legal/yandex_plus_privilege_list, for a fee for a limited period of time. Furthermore, access to the Content can be provided on no more than 2 devices of the User. Simultaneous playback of audio, as well as audiovisual works is possible on no more than one User’s device.

Yandex.Music Service shall mean Yandex.Music service available at http://music.yandex.xx (where xx is any of the first level domain names) or via Yandex.Music mobile app the copyright holder whereof is Yandex.Mediaservices LLC (OGRN 1187746644920), the right of use granted under the terms and conditions stipulated in License Agreement for Yandex.Music for Mobile Devices (https://yandex.ru/legal/music_mobile_agreement) and Terms of Use of Yandex.Music Service (https://yandex.ru/legal/music_termsofuse) where sound records, lyrics, music album covers and other materials are available.

Kinopoisk Service shall mean a service for content viewing the detailed information whereof is available at: https://www.kinopoisk.ruand the copyright holder whereof is Kinopoisk LLC (OGRN 1077759854919), the right of use granted under the terms and conditions stipulated in License Agreement for Kinopoisk for Mobile Devices (https://yandex.ru/legal/kinopoisk_mobile_agreement), User Agreement for Kinopoisk Website (https://yandex.ru/legal/kinopoisk_termsofuse) and Terms and Conditions for Viewing Paid Content on the Kinopoisk Service (https://yandex.ru/legal/kinopoisk_vod).

Content shall mean a collection of audio and audiovisual works, descriptions of works, graphic images in streaming mode and/or by downloading to a user's device via the Internet and other materials available under the Subscription for viewing and/or listening through the Internet using Kinopoisk Service, including using the services of affiliates (if applicable), and/or a collection of musical works (sound records) with or without text, lyrics of musical works in electronic form, graphic images of music album covers and other materials available under the Subscription for viewing and/or listening via the Internet using the Yandex.Music Service depending on the location of the User.

User shall mean an Internet user with electronic device (or proxy server) IP address Yandex believes to be related to one of the following countries: Russian Federation, Republic of Moldova, Republic of Armenia, Azerbaijan Republic, Georgia, Kyrgyz Republic, Republic of Tajikistan, Mongolia, Republic of Kazakhstan, Republic of Belarus, Republic of Uzbekistan, Israel, Canada, Romania, Slovakia, Slovenia, Poland, Lithuania, Latvia, Bulgaria, Czech Republic, Montenegro, Estonia, Great Britain, Norway, France, Italy, Spain, Greece, Austria, Finland, Portugal, Cyprus, Tunisia, Egypt, South Korea, UAE, Thailand, Indonesia, Argentina, India, Vietnam, Australia, Japan, Germany, USA, Turkmenistan, who is granted access to the Content under the Subscription or is a member of the User's family who purchased the Plus Multi Subscription or Plus Multi with more.tv Subscription (Family Subscription), if the Subscription is available in the respective country, the information where is available at: https://yandex.ru/legal/yandex_plus_privilege_list.

Plus Multi Subscription shall mean the provision of the User and up to three members of the User's family added by the User with the opportunity to access the Content for a fee for a limited period of time under the Yandex Plus Subscription. Members of the User’s family shall mean persons living together with the User (hereinafter referred to as the "Members of the User’s Family"). Furthermore, access to the Content can be provided on no more than 10 devices of the User and the User’s family members. Simultaneous playback of audio, as well as audiovisual works is possible on no more than 5 devices of the User and the User’s family members. Plus Multi Subscription may be unavailable in some countries. The ability to add Members of the User’s Family may not be available to the User, who is the member of the Family account under the conditions stipulated in document https://yandex.ru/legal/rules (hereinafter referred to as the “Family account”), if the User is not a person who initiated the creation of the Family Account (hereinafter referred to as the “Owner of the Family Account”).

Plus with more.tv Subscription is enabling the User to access the Content, as well as a portion of the audiovisual works available in the online service more.tv, for a fee for a limited period of time. Plus with more.tv Subscription is available only to Internet users who have an IP address of an electronic device (or proxy server) on the Internet that, according to Yandex, belongs to the Russian Federation.

Plus Multi with more.tv Subscription is enabling the User and no more than three members of his family added by him to access the Content, as well as a portion of the audiovisual works available in the online service more.tv, for a fee for a limited period of time. Plus Multi with more.tv Subscription can only be accessed by Internet users who have an IP address of an electronic device (or proxy server) on the Internet that, according to Yandex, belongs to the Russian Federation. Subscriptions/Subscription shall mean Yandex Plus Subscription, Plus Multi Subscription, Yandex Plus with more.tv Subscription and Plus Multi with more.tv Subscription. The ability to add Members of the User’s Family may not be available to the User, who is the member of the Family account under the conditions stipulated in document https://yandex.ru/legal/rules (hereinafter referred to as the “Family account”), if the User is not a person who initiated the creation of the Family Account (hereinafter referred to as the “Owner of the Family Account”).

Yandex Plus World of Tanks Basic Subscription - providing a User with an electronic device (or proxy server) Internet IP address, according to Yandex information relating to one of the following countries: the Russian Federation, the Republic of Kazakhstan, the Republic of Belarus, an opportunity to access Content for a fee for a limited period of time and to use Non-activated data and Commands in the massively multiplayer online game "World of Tanks" (hereinafter referred to as the "Game") from the Wargaming Group Limited (hereinafter referred to as "WARGAMING"), including:

- a customization element – a decal (6 copies);

- 3 of the following 8 elements, at the User's choice (the selection of elements must be made in the Game client no later than one month from the beginning of the Subscription Period, otherwise they become unavailable):

(element 1) rental premium tank of VI-VIII level for 3 days of rent;

(element 2) rental premium tank of VI-VIII level for 3 days of rent;

(element 3) rental premium tank of VI-VIII level for 3 days of rent;

(element 4) equipment - automatic fire extinguisher (5 pcs.);

(element 5) equipment - large repair kit (5 pcs.);

(element 6) equipment - large first aid kit (5 pcs.);

(element 7) task for x5 experience for 3 executions;

(element 8) 1 personal reserve: +50% to credits for a fight for 1 hour;

- 3 special offers in the in-game or premium Game store, including purchasing of the rental tanks.

Yandex Plus World of Tanks Standard Subscription - providing a User with an electronic device (or proxy server) Internet IP address, according to Yandex information relating to one of the following countries: the Russian Federation, the Republic of Kazakhstan, the Republic of Belarus, an opportunity to access Content for a fee for a limited period of time and to use Non-activated data and Commands in the massively multiplayer online game "World of Tanks", including:

- 900 in-game gold pieces;

- a customization element – a decal (6 copies);

- 3 of the following 8 elements, at the User's choice (the selection of elements must be made in the Game client no later than one month from the beginning of the Subscription Period, otherwise they become unavailable):

(element 1) rental premium tank of VI-VIII level for 5 days of rent;

(element 2) rental premium tank of VI-VIII level for 5 days of rent;

(element 3) rental premium tank of VI-VIII level for 5 days of rent;

(element 4) equipment - automatic fire extinguisher (10 pcs.);

(element 5) equipment - large repair kit (10 pcs.);

(element 6) equipment - large first aid kit (10 pcs.);

(element 7) task for x5 experience for 5 executions;

(element 8) 4 personal reserves: +50% to credits for a fight for 1 hour;

- 5 special offers in the in-game or premium Game store, including purchasing of the rental tanks and 2 other special offers;

- a 5% premium Game store discount for several Game sets;

Yandex Plus World of Tanks Maximum Subscription - providing a User with an electronic device (or proxy server) Internet IP address, according to Yandex information relating to one of the following countries: the Russian Federation, the Republic of Kazakhstan, the Republic of Belarus, an opportunity to access Content for a fee for a limited period of time and to use Non-activated data and Commands in the massively multiplayer online game "World of Tanks", including:

- 2 200 in-game gold pieces;

- a unique 2D style (may be either included or not included in the set in certain months at the discretion of WARGAMING);

- a customization element – a decal (6 copies);

- a crew member (offered crew members may change, may be included or not included in the set in certain months at the discretion of WARGAMING);

- 3 of the following 8 elements, at the User's choice (the selection of elements must be made in the Game client no later than one month from the beginning of the Subscription Period, otherwise they become unavailable):

(element 1) rental premium tank of VI-VIII level for 7 days of rent;

(element 2) rental premium tank of VI-VIII level for 7 days of rent;

(element 3) rental premium tank of VI-VIII level for 7 days of rent;

(element 4) equipment - automatic fire extinguisher (15 pcs.);

(element 5) equipment - large repair kit (15 pcs.);

(element 6) equipment - large first aid kit (15 pcs.);

(element 7) task for x5 experience for 10 executions;

(element 8) 10 personal reserves: +50% to credits for a fight for 1 hour;

- 7 special offers in the in-game or premium Game store, including purchasing of the rental tanks;

- a 10% premium Game store discount for several Game sets.

Subscriptions/Subscription shall mean Yandex Plus Subscription, Plus Multi Subscription, Yandex Plus World of Tanks Basic Subscription, Yandex Plus World of Tanks Standard Subscription, Yandex Plus World of Tanks Maximum Subscription.

Advanced Yandex Plus Subscription shall mean enabling the User that has an active and paid Subscription and uses Yandex.Taxi Service (only in the mobile application Yandex.Taxi or Yandex Go) to order the transportation of passengers and baggage under such tariffs as Comfort, Comfort+, Driver, Business, Premier, Élite, and Cruise, to make use of extra marketing offers at an additional charge during a limited period as described in this document (hereinafter referred to as the “Advanced Privileges”) pursuant to the rules outlined in the Conditions.

Additional option shall mean enabling the Subscription User to purchase options described at: https://yandex.ru/legal/yandex_plus_opzii_list, in accordance with the rules specified in the Terms. The list of available Additional options for each type of Subscriptions is available at: https://yandex.ru/legal/yandex_plus_opzii_list.

Subscription Period to the Additional option shall mean the period of time specified in the Personal Account (for example, a month) for which the Additional option is issued and the corresponding fee is set.

Subscription Period shall mean a period of time (for example, a month or a year) specified in the Personal Account, for which the Subscription is made and the corresponding fee is set.

The one-month Subscription Period begins from the date the Subscription is paid and expires on the corresponding date of the calendar month following the Subscription payment date.

The one-year Subscription Period begins from the date the Subscription is paid and expires in the corresponding month and on the corresponding date of the calendar year following the Subscription payment date.

Yandex shall mean YANDEX LLC, OGRN 1027700229193 with office at 16 Leo Tolstoy St., Moscow, 119021, Russia.

1. General Provisions

1.1. This document (hereinafter referred to as the "Terms and Conditions") sets rules and terms and conditions for provision of the Subscriptions, Additional option, Advanced Yandex Plus Subscriptions to Users.

1.2. Upon making a Subscription and/or Additional option, the User shall be deemed to have accepted the Terms and Conditions and the provisions of all documents referred to in the Terms and Conditions, in full, without reservation or exception. If the User disagrees with the provisions of these documents, the User shall terminate the Subscription and/or refuse Additional option in his or her Personal Account.

Members of the User’s Family who have performed actions aimed at gaining access to Content via Plus Multi Subscription, within the framework of the Additional Option «Family Subscription» shall be considered to have accepted the Terms and Conditions and the provisions of all documents referred to by the Terms and Conditions, in full, without reservation or exception. If the Member of the User’s Family disagrees with the provisions of these documents, the Member of the User’s Family shall stop using the Plus Multi Subscription, the Additional Option «Family Subscription».

For the purposes of the Terms and Conditions, the Personal Account shall mean the User’s account in Yandex (its affiliates') services (including mobile applications) with user information and other information related to the use of the said services by the User, which he or she can access having logged in with the User's login and password in Yandex (its affiliates') services.

The Subscription User may also take advantage of additional marketing offers, which description is provided at: https://yandex.ru/legal/yandex_plus_privilege_list (hereinafter referred to as the "Benefits"), in accordance with the rules specified in the Terms and Conditions.

1.3. Yandex may amend the Terms and Conditions and the documents referred to in the Terms and Conditions without any special notice; revised Terms and Conditions and the documents referred to in the Terms and Conditions shall come into effect once posted online at the URL specified in this Clause (or the address that referred to the Terms and Conditions), unless otherwise stipulated in revised Terms and Conditions and/or the documents referred to in the Terms and Conditions. The current Terms and Conditions are always available at: https://yandex.ru/legal/yandex_plus_conditions/?lang=en.

1.4. If Yandex has made any amendments to the Terms and Conditions and/or the documents referred to in the Terms and Conditions as prescribed by Clause 1.3 of the Terms and Conditions that the User disagrees with, he or she shall terminate the Subscription and/or refuse Additional option in his or her Personal Account. However, any actions the User performs to obtain remote access to the Content under the Subscription (and/or including the use of any Benefits) and/or the use of Additional option after the revised Terms and Conditions and/or documents referenced by the Terms and Conditions became effective shall constitute a confirmation of the User’s consent with the revised Terms and Conditions and the documents referred to in the Terms and Conditions.

1.5. Access to the Content and the use of Benefits indicated at https://yandex.ru/legal/yandex_plus_privilege_list is only available to Users with electronic device (or proxy server) IP address Yandex believes to be related to one of the following countries: Russian Federation, Republic of Moldova, Republic of Armenia, Azerbaijan Republic, Georgia, Kyrgyz Republic, Republic of Tajikistan, Mongolia, Republic of Kazakhstan, Republic of Belarus, Republic of Uzbekistan, Israel, Canada, Romania, Slovakia, Slovenia, Poland, Lithuania, Latvia, Bulgaria, Czech Republic, Montenegro, Estonia, Great Britain, Norway, France, Italy, Spain, Greece, Austria, Finland, Portugal, Cyprus, Tunisia, Egypt, South Korea, UAE, Thailand, Indonesia, Argentina, India, Vietnam, Australia, Japan, Germany, USA, Turkmenistan, taking into account the User's location.

The User may have other benefits specified in the Personal Account under the terms described in the Personal Account.

The ability to purchase certain Additional options is available only to the Subscription Users with electronic devices (or proxy servers) IP address Yandex believes to be related to the countries, indicated at https://yandex.ru/legal/yandex_plus_opzii_list.

1.6. By making a Subscription and/or Additional option, the User:

1.6.1. confirms that he or she is legally capable and has reached the age stipulated by the laws of the Russian Federation and the User's governing law to effect transactions as per these Terms and Conditions.

1.6.2. guarantees the reliability of the personal data he or she provided when signing up, using Yandex (its affiliates') services, and making a Subscription and/or Additional option, accepts responsibility for their accuracy, completeness, and reliability. The User shall take all possible risks associated with his or her actions performed with errors or inaccuracies in the personal data he or she provided.

1.6.3. confirms that he or she has read and unconditionally accepted the Terms and Conditions and the fact that he or she understands the provisions of the Terms and Conditions and the documents referred to in the Terms and Conditions;

1.6.4. gives his or her consent to receive advertising and informative messages. The User may refuse to receive promotional messages as the User Agreement for Yandex Services (https://yandex.ru/legal/rules) prescribes or following the instructions specified in a message received.

1.6.5. confirms that he or she accepts the terms and conditions stipulated by the following documents:

• Yandex Plus Content and Benefits (https://yandex.ru/legal/yandex_plus_privilege_list);
• License Agreement for Kinopoisk for Mobile Devices (https://yandex.ru/legal/kinopoisk_mobile_agreement);
• User Agreement for Kinopoisk Website (https://yandex.ru/legal/kinopoisk_termsofuse);
• Terms and Conditions for Viewing Paid Content on the Kinopoisk Service (https://yandex.ru/legal/kinopoisk_vod);
• Rules of the loyalty program Yandex Plus Cashback (https://yandex.ru/legal/plus_loyalty);
• other documents specified on web-page: https://yandex.ru/legal/yandex_plus_privilege_list and on web-page https://yandex.ru/legal/yandex_plus_opzii_list;

other documents specified in the Personal Account that define terms and conditions of provision of corresponding Subscriptions to the User.

2. Subscription and Additional options

2.1. Making a Subscription and/or Additional option, access to the Content and use of Benefits are only available to the User, who logged into Yandex services as prescribed by the User Agreement for Yandex Services (https://yandex.ru/legal/rules) and User Agreements for certain Yandex (its affiliates and third-party partners) services listed at https://yandex.ru/legal/yandex_plus_privilege_list and in the Personal Account.

2.1.1. Making a Subscription and/or Additional option is not available to the User, who is the member of the Family account, if the User is not an Owner of the Family Account at the same time, when paying for a Subscription and/or Additional option with a Family card.

For the purposes of these Terms, a Family card means a bank card linked to the account of the Owner of the Family Account, on the terms and in the manner provided for by the documents published at: https://yandex.ru/legal/rules and https://yandex.ru/legal/bank_card.

2.2. Additional information might be required in the Personal Account to access the Content and/or certain Subscription Benefits and/or Additional option. The User shall add missing information or he/she may be denied the provision of remote access to the relevant Content and/or certain Benefits under the Subscription and/or Additional option.

2.3. By making a Subscription and/or Additional option, the User buying a Subscription and/or Additional option enters into a contract with Yandex (hereinafter referred to as the "Contract") under the terms and conditions stipulated by this document and the provisions of Art. 429.4 of the Civil Code of the Russian Federation (subscriber's contract). Under the Contract, Yandex undertakes to grant to the User remote access via Internet to the Content and Benefits for the duration of the Subscription Period as well as to the Additional option for the Additional option Subscription Period, if it was issued by the User, and the User undertakes to pay for the Subscription (except as specified in Clause 3.7 of the Terms and Conditions) and/or for the Additional option. If the User orders Advanced Yandex Plus Subscription, Yandex shall also enable the User to make use of the Advanced Privileges in accordance with the Agreement and these Terms and Conditions.

2.4. The amounts of the Subscription fee and the Additional option fee to be transferred by the User buying a Subscription and/or Additional option to Yandex's account are specified in the Personal Account. Unless the Personal Account specifies otherwise, the fee is charged for each Subscription Period, Additional option Subscription Period the User buying a Subscription, and/or Additional option determined when subscribing or making Additional option.

2.5. The User buying a Subscription and/or Additional option shall pay for the Subscription and/or Additional option as specified in this Clause. In order to make a Subscription and/or Additional option and further pay for it, the User buying a Subscription and/or Additional option may link his or her bank card and/or electronic payment instrument to his or her Personal Account (the "Linked Card"). For the purposes of these Terms and Conditions, any bank card and/or electronic payment instrument linked to the Personal Account (including those linked when, prior to, or after making a Subscription and/or Additional option) shall be deemed to be a Linked Card. Yandex may debit any of the Linked Cards with the amount equal to the Subscription fee and/or Additional option fee.

To confirm the validity of a Linked Card, Yandex may charge (hold) the amount up to RUB 500 (or the equivalent amount in the currency of the User’s country) to be refunded to the User who bought the Subscription and/or Additional option, if the transaction is successful. Failure to charge the said amount means that it is impossible to add this Linked Card and subscribe/pay for the Subscription and/or Additional option.

When the User enters the Linked Card data and further uses the Linked Card, he or she confirms and guarantees that he or she has specified the accurate and complete data of the valid bank card issued in his or her name; he or she complies with the rules of international payment systems and the requirements of the issuing bank that has issued the Linked Card, inter alia, in terms of non-cash settlements; he or she specified the accurate and complete data of the electronic payment instrument; he or she complies with the e-money operator's requirements.

Yandex reserves the right to require at any time that the User confirm the details he or she has specified in the Personal Account, including the details of the Linked Card, and request supporting documents (in particular, identity documents); if Yandex so decides, failure to provide these documents may amount to the provision of unreliable information and have consequences stipulated by Clause 3.1 of the Terms and Conditions.

When a User located in Israel, Georgia makes a payment for Subscription using a local bank card, Yandex Services AG (Identification No: CHE-229.170.782) is the recipient of the payment, since it acts on behalf of YANDEX LLC and is authorized by it to accept funds from the User as payment for the Subscription with the involvement of an authorized payment processor, or an operator of electronic funds, or other participants in settlements or information technology interaction, on its behalf, but at the expense of YANDEX LLC

2.6. Remote access to the Subscription shall be deemed to be granted to the User for the Subscription Period in full from the moment the User pays for the Subscription in the Yandex server, provided that the fact of payment is reflected in the Yandex electronic accounting system (or from different time in cases specified in the Personal Account).

Yandex's obligations to grant remote access to the Subscription to the User shall be deemed to have been fulfilled regardless of whether the User requested that Yandex shall fulfill the same during the Subscription Period.

Remote access to the Additional option is considered to be provided to the User for the Additional option Subscription Period in full from the moment the User pays for the Additional option on the Yandex server, provided that the fact of payment is reflected in the Yandex electronic payment accounting system (or from another moment in the cases specified in the Personal Account).

Yandex's obligations to provide the User with remote access to the Additional option are considered fulfilled to the User regardless of whether the User requested the corresponding performance from Yandex during the Additional option Subscription Period.

Yandex's obligations to provide the User with remote access to the corresponding Yandex Plus World of Tanks Subscription are considered fulfilled regardless of whether the User has linked his/her account in accordance with clause 4.16 of the Terms.

2.7. The Content and/or Benefits provided by Yandex or third parties (partners) are also available to the User under the Subscription. Yandex or program partners shall provide the User with the access to the Content and/or Benefits on demand, i.e. when the User uses services, features, accesses, etc. provided for by the Yandex Plus Content and Benefits document and subject to the terms and conditions stipulated at https://yandex.ru/legal/yandex_plus_privilege_list or in the Personal Account.

2.8. When subscribing, the User agrees that for each Subscription Period the User determined when subscribing Yandex may, as an advance fee, charge the Subscription fee (subscriber fee) set by Yandex on the day of payment until the User who bought the Subscription refuses to renew the Subscription for the next Subscription Period.

When arranging the Additional option (except for the Additional Option «Family Subscription»), the User purchasing the Additional option agrees that Yandex has the right to charge the prepayment fee established by Yandex for the Additional option (subscription fee) each Additional option Subscription Period specified by the User when making the Additional option, until refusal of the User who purchased the Additional option to renew the Additional option for the next Additional option Subscription Period.

2.9. The User acknowledges and agrees that the Subscription and/or Additional option is automatically made for an indefinite period of time from the date the first Subscription Period and/or Additional option Subscription Period respectively is paid for. The User buying the Subscription and/or Additional option may refuse to renew the Subscription and/or Additional option for the next Subscription Period and/or Additional option Subscription Period respectively in his or her Personal Account. In this case, the Subscription (namely, the User’s remote access to the Content and the Benefits) shall be terminated from the day following the last day of the paid Subscription Period, and Additional option shall be terminated from the day following the last day of the paid Additional option Subscription Period. Moreover, Yandex may terminate the Subscription and/or Additional option in other cases or for other reasons as stipulated in the Terms and Conditions.

If the User's bank challenges a transaction carried out using a bank card to pay for the Subscription, the Additional Option, or the Advanced Yandex Plus Subscription, Yandex may treat it as the User's refusal from Subscription and/or an Additional Option and/or the Advanced Yandex Plus Subscription from the date Yandex receives the corresponding request from the User's bank.

When the User purchases the Additional option while having the Subscription, if the User refuses the Subscription, Yandex has the right to unilaterally terminate the provision of the Additional option to the User upon expiry of the already paid Additional option Subscription Period.

If the User wishes to arrange the Additional option separately from the Subscription, he or she must contact the support service via the form https://yandex.ru/support/plus-ru/troubleshooting.html.

2.10. If the balance of the Linked Card is insufficient to renew the Subscription and/or Additional option, Yandex may choose not to cancel the User's access to the Subscription and/or Additional option until the Linked Card is debited with the subscription fee amount. Yandex may treat a long-term insufficient balance of the Linked Card as the User's refusal to renew the Subscription and/or Additional option from the date the unpaid Subscription Period/ Additional option Subscription Period begins.

2.11. By accepting the Terms and Conditions, the User buying the Subscription and/or Additional option consents to the regular automatic debiting of his/her account to pay for the Subscription and/or Additional option and acknowledges that debit orders issued under this clause of the Terms and Conditions are those of the User, and the processing center's and the acquiring bank's actions taken to debit the User's account in accordance with this Clause of the Terms and Conditions are performed with the User's consent.

Automatic debiting under this clause of the Terms and Conditions begins subject to the following:

• the User enters all the required details of the Linked Card;
• the automatic Linked Card debiting service is activated as follows: automatically when the first payment is made;
• by clicking the Subscribe button, the button to arrange Additional option (or any other similar button), which shall mean the User consents with these Terms and Conditions.

2.12. The User confirms that Yandex may transfer personal details the User provides to Yandex when he or she uses Yandex services and under the Subscription (including when providing access to the Content and/or when he or she uses Benefits) and/or Additional option, inter alia, when making and paying for the Subscription and/or Additional option, to the Benefits program partners for them to fulfill their Benefits program obligations to Users and to third parties Yandex involved to exercise its rights and duties under the Terms and Conditions. The User agrees that Yandex may store the User’s personal details for at least three years from the Subscription Period / Additional option Subscription Period end.

2.13. The User shall independently check the Subscription status, Additional option status in the Personal Account (paid Subscription Period, paid Additional option Subscription Period, Subscription fee, Additional option fee list of available Content and Benefits which may be changed, inter alia, supplemented/reduced) and track amendments to the Terms and Conditions at https://yandex.ru/legal/yandex_plus_conditions/?lang=en and terms and conditions for granting Content and benefits at https://yandex.ru/legal/yandex_plus_privilege_list , at https://yandex.ru/legal/yandex_plus_opzii_list and in the Personal Account which shall become effective from the date of making the corresponding change in the Personal Account (unless another effective date for the change is indicated in the Personal Account) or at the specified web-pages.

2.14. The User accepts and agrees that any change in the list of Benefits and/or Content under the Subscription shall not be a ground for cancellation of the Subscription, revision of its cost for the paid Subscription Period, or making a refund for the Subscription. The User accepts and agrees that, regardless of the fact of provision of remote access to the Content, some Content and/or Benefits may be unavailable in the User’s region (assumed geographical location of the User Yandex determined automatically). Some Content and/or Benefits may be unavailable to Users as per documents governing the use thereof (including documents governing the use of Yandex services and services of Yandex Plus Content and Benefits program partners under which the Content and Benefits are granted). Such circumstances shall not be the grounds for canceling the Subscription, revising its cost for the paid Subscription Period, or making a refund for the Subscription.

2.15. The User may have access to the functionality of posting publications, including wishes and suggestions for improving the Subscription, on the pages https://yandexplus.userecho.com (hereinafter referred to as the "Site for wishes"). Yandex only administers the Site for wishes. By posting publications on the Site for wishes, the User undertakes to comply with the requirements of the current legislation, these Terms and Conditions, the Terms of Service posted at: https://userecho.com/terms-of-service and the rules published at: https://yandex.ru/support/plus/list-rules.html.

2.16. The User is solely responsible for the information posted on the Site for wishes and/or communicated to other Users or third parties through the Site for Wishes, including its content and its compliance with the requirements of the current legislation of the Russian Federation, for violation of the rights of third parties by posting information (including, but not limited: the rights of the author and/or related rights, rights to means of individualization and other rights protected by law). The User independently compensates any losses (including lost profits, moral and other harm) incurred by other Users, Yandex or third parties in connection with the User's use of the Site for wishes.

2.17. A User who has subscribed to Yandex Plus, Plus Multi in accordance with the Terms with a Subscription Period of one month (except for cases of Yandex Plus Subscription, Plus Multi Subscription in stores or with telecom operators) may have access to the functionality to suspend Yandex Plus Subscription, Plus Multi Subscription for a period not exceeding 56 (fifty six) calendar days and not more often than once every six months. After the expiration of the suspension period of Yandex Plus Subscription, Plus Multi Subscription, Yandex Plus Subscription, Plus Multi Subscription is renewed for the term of the previously unused prepaid period of Yandex Plus Subscription, Plus Multi Subscription, subject to its automatic renewal in accordance with clause 2.9 of the Terms. During the period of suspension of Yandex Plus and Plus Multi Subscription, the User is considered to have no active Yandex Plus and Plus Multi Subscription.

2.18. In the case of subscribing through a store or a telecom operator, the relationship between the User and Yandex in terms of paying for the Subscription, the possible Subscription Period, cancellation or renewal of the Subscription, the conditions for providing a free Subscription Period are governed by these Terms, unless otherwise specified in the documents of the stores or telecom operators, which the User agrees with when subscribing.

3. Advanced Yandex Plus Subscription

3.1. Taking out Subscription on the territory of the Russian Federation from 12.08.2020, on the territory of the Republic of Kazakhstan from 29.09.2021, on the territory of the Republic of Belarus from 14.10.2021, the User also simultaneously agrees to the registration and completes the order of the Advanced Yandex Plus Subscription.

3.2. The User who has an active Subscription entered on the territory of the Russian Federation before 12.08.2020, on the territory of the Republic of Kazakhstan before 29.09.2021, on the territory of the Republic of Belarus before 14.10.2021, may order Advanced Yandex Plus Subscription using Yandex.Taxi or Yandex Go mobile application (hereinafter referred to as “Yandex.Taxi Service”) or through the website https://plus.yandex.ru (hereinafter referred to as “Plus Website”). This option is not available unless and until the User has logged in to Yandex.Taxi Service or Plus Website through their Personal Account (User account with Yandex ID https://passport.yandex.ru). This option can be made available to the User in Yandex.Taxi Service interface or on Plus Website by means of an option to agree to the crediting of points under Yandex Plus Cashback Loyalty Program (including without limitation in such wordings as “Activate the Points” or “Go to Taxi Points”), or by not performing actions in the Yandex.Taxi Service interface or on the Plus Website, aimed at canceling the Advanced Yandex Plus Subscription level prior to a certain date specified in the interface and/or notification.

3.3. By ordering Advanced Yandex Plus Subscription, the User simultaneously agrees to the Rules of Yandex Plus Cashback Loyalty Program (https://yandex.ru/legal/plus_loyalty). Ordering Advanced Yandex Plus Subscription and using the Advanced Privileges as part of Advanced Yandex Plus Subscription is not possible until the User has agreed and accepted the above Rules of Yandex Plus Cashback Loyalty Program.

3.4. When ordering Advanced Yandex Plus Subscription in the manner provided by clauses 3.1 and 3.2 of the Terms and Conditions, the User agrees that Advanced Yandex Plus Subscription charge will be written off at the placement of each order [1] for the transportation of passengers and baggage on the territory of the Russian Federation under such tariffs as Comfort, Comfort+, Driver, Business, Premier, Élite, and Cruise, on the territory of the Republic of Kazakhstan - Comfort, Comfort +, Business, on the territory of the Republic of Belarus - Comfort, Comfort +, Business, through Yandex.Taxi Service, with cashless payment mode (including payment with Family card – for Russian Federation) selected by the User, until the User rejects the provision of Advanced Yandex Plus Subscription in the manner provided by clause 3.5 of the Terms and Conditions. In this case, the User is provided with a 10% discount on ordering services for the transportation of passengers and baggage, upon placing which the User pays for the Advanced Yandex Plus Subscription. The specified discount is equal to the amount debited when purchasing the Advanced Yandex Plus Subscription, i.e. the cost of the trip is reduced by the cost of the Advanced Yandex Plus Subscription (How does it work?).

If the User at the placement of the order for the transportation of passengers and baggage under tariffs specified above (respectively) on the territory of the Republic of Belarus, Republic of Kazakhstan uses a function «Joint account» (the function of creating a joint account in the Yandex.Go program for mobile devices) under the terms and conditions stipulated in document https://yandex.ru/legal/taxi_termsofuse/index.html, or on the territory of the Russian Federation uses a business-account within the function «Joint account» (hereinafter referred to as the “Business-Account”), and makes a payment for the transportation of passengers and baggage with the bank card of the User who created the Joint account (for the Republic of Belarus, Republic of Kazakhstan) or Business-account (for the Russian Federation) linked to such Joint account or Business-account respectively, the ordering of Advanced Yandex Plus Subscription is unavailable for him.

The procedure for adding and using linked cards, including linked cards within the Family Account, is governed by the document published at: https://yandex.ru/legal/bank_card.

3.5. The User may reject the provision of Advanced Yandex Plus Subscription by applying to Yandex.Taxi (Yandex Go) Service support service through the feedback form at the Russian Federation - https://yandex.ru/support/taxi/cost-trip.html, for the Republic of Kazakhstan - https://yandex.kz/support/taxi/cost-trip.html, for the Republic of Belarus - https://yandex.by/support/taxi/cost-trip.html. In this respect, if the User rejects the continued provision of Advanced Yandex Plus Subscription, the Advanced Privileges will no longer be available thereto upon the expiration of their term of use as indicated in the Terms and Conditions. If the User entering the Subscription on the territory of the Russian Federation from 12.08.2020, on the territory of the Republic of Kazakhstan from 29.09.2021, on the territory of the Republic of Belarus from 14.10.2021, is unwilling to use the Advanced Privileges as part of Advanced Yandex Plus Subscription, the User shall immediately after entering the Subscription, but in any case before placing the first successive order for the transportation of passengers and baggage under the tariffs indicated in clause 3.4 inform the support service of Yandex.Taxi (Yandex Go) Service thereabout by using the feedback form at: for the Russian Federation - https://yandex.ru/support/taxi/cost-trip.html, for the Republic of Kazakhstan - https://yandex.kz/support/taxi/cost-trip.html, for the Republic of Belarus - https://yandex.by/support/taxi/cost-trip.html.

3.6. The Advanced Yandex Plus Subscription charge is written off by Yandex.Taxi (Yandex Go) LLC (OGRN 5157746192731), on the territory of the Republic of Kazakhstan by Yandex.Taxi Corp LLP (BIN: 160540014930), on the territory of the Republic of Belarus by Uber ML B.V. (Registration number: 69453632) on behalf of Yandex. The Advanced Yandex Plus Subscription charge is written off by using a Linked Card within the meaning defined in the document «Terms of Use of Yandex.Taxi (Yandex Go)» (https://yandex.ru/legal/taxi_termsofuse) — for the Russian Federation, the Terms of use of the Yandex.Taxi (Yandex Go) Service (https://yandex.com/legal/yandexgo_termsofuse) — for the Republic of Kazakhstan and the Terms of use of the Yandex.Taxi (Yandex Go) Service (https://yandex.com/legal/yandexgo_termsofuse/#index__belarus_ru) — for the Republic of Belarus. Yandex reserves the right to request the User at any time to confirm the Linked Card details indicated in Yandex.Taxi (Yandex Go) Service and to request the provision of supporting documents therefor (particularly, identity documents) non-provision of which may, at the discretion of Yandex, be treated as the provision of false information and result in consequences provided by clause 4.1 of the Terms and Conditions.

3.7. The Advanced Yandex Plus Subscription charge amounts to 10 % of the price of services for the transportation of passengers and baggage under the tariffs indicated in clause 3.4 of the Terms and Conditions as specified when ordering such a transportation through Yandex.Taxi (Yandex Go) Service exclusive of the discount from the cost of such transportation provided as part of the Advanced Privileges but considering the discounts provided on other grounds. The above charge is inclusive of VAT.

3.8. The User may use the Advanced Privileges as part of Advanced Yandex Plus Subscription. The Advanced Privileges may not be used until the User has logged in through the Personal Account to which the User logged in when ordering Advanced Yandex Plus Subscription. The Advanced Privileges are made available only if the User has an active Subscription.

3.9. Types of Advanced Privileges, their terms and periods of use are indicated in the Terms and Conditions. Different types of Advanced Privileges may be available to the User depending on the number of orders for the transportation of passengers and baggage made and payment for Advanced Yandex Plus Subscription.

3.10. The Advanced Privileges may be used only by Users that have IP-addresses of electronic devices (or proxy servers) which, as Yandex has reasons to believe, belong to the Russian Federation, the Republic of Kazakhstan, the Republic of Belarus.

3.11. The User shall independently refer to the Personal Account and the Terms and Conditions to monitor any modifications in the terms of the use of the Advanced Privileges which come into effect as of a relevant modification is entered to the Personal Account (unless some other effective date is indicated in the Personal Account) or to this document.

3.12. The User acknowledges and agrees that any modification in the list of the Advanced Privileges as part of Advanced Yandex Plus Subscription shall not form a basis for cancellation of an order placed for Advanced Yandex Plus Subscription, revision of its price, which has been paid, or refund of money paid for Advanced Yandex Plus Subscription. The User acknowledges and agrees that the Advanced Privileges may be unavailable in the User's region (the assumed geographical region of the User's location determined by Yandex automatically), some Advanced Privileges may be unavailable to Users in accordance with the provisions of documents regulating their use including documents regulating the use of services provided by Yandex and its partners). The above circumstances shall not form a basis for cancellation of an order placed for Advanced Yandex Plus Subscription, revision of its price, which has been paid, or refund of money paid for Advanced Yandex Plus Subscription.

3.13. The User's inability to use the Advanced Privileges within the Advanced Yandex Plus Subscription in any case cannot be considered as a violation by Yandex of its obligations under the Subscription.

3.14. Payment for Advanced Yandex Plus Subscription when ordering the transportation of passengers and baggage under the tariffs indicated in clause 3.4 of the Terms and Conditions through Yandex.Taxi (Yandex Go) Service is a compulsory (but not the only one) condition for the crediting of Points under Yandex Plus Cashback Loyalty Program in connection with such an order being placed in Yandex.Taxi (Yandex Go) Service.

4. Miscellaneous. Restrictions

4.1. Yandex reserves the right to deny the User an access to the Subscription (Content and/or Benefits), Advanced Privileges, Additional options or restrict access to the Subscription (Content and/or Benefits), Advanced Privileges (or to certain functions of the Service, where technically possible), Additional options using the Personal Account or completely block the User’s account, if Yandex so decides, inter alia, if it finds out that the User provided incomplete or inaccurate data, if the User violated these Terms and Conditions or the laws of the Russian Federation or the User's country of location, as well as if the provision of Subscriptions, Additional options violates the legislation applicable to the Yandex group. If the account is blocked because the User provided inaccurate personal data or if the User violated these Terms and Conditions, the amount of the subscription fee the User has paid for the current Subscription Period / Additional option Subscription Period will not be recalculated/refunded.

4.2. Yandex may unilaterally revise the Subscription, Advanced Yandex Plus Subscription fee, Additional options. At the same time, the User who has made, and paid for, the Subscription (with automatic renewal) and/or Additional option shall be notified of this change no later than three (3) calendar days before the changes take effect as follows (as Yandex thinks fit): by posting revised Terms and Conditions at: https://yandex.ru/legal/yandex_plus_conditions/?lang=en or by posting information about the new subscription fee in the Personal Account, in marketing and promotional materials provided to Users via the Internet/telecommunication channels. At the same time, the fee for the Subscription Period / Additional option Subscription Period actually paid by the User at the time of making the respective changes is not subject to change.

4.3. According to the general rule, the User is identified by the details of his or her account in Yandex services. Yandex may use other data to identify the User, including data on the payer, when such identification does not violate rights of the parties concerned, rights of third parties, or applicable laws.

4.4. Except as expressly stated otherwise in the Personal Account, the User may not transfer his or her Subscription, Additional option, Advanced Yandex Plus Subscription rights and/or obligations to third parties, whether for payment or free of charge. Yandex also reserves the right to refuse to transfer the User's Subscription to User's another Personal Account if the User is granted access to the Subscription without independently issuing and/or paying for the Subscription.

4.5. The User shall not misuse the granted remote access to the Content, the Privileges as part of the Subscription, the Additional option, and the Advanced Privileges as part of Advanced Yandex Plus Subscription, including not to perform any acts aimed at using the Content, the Privileges, the Advanced Privileges, Additional options for the benefit of third parties.

4.6. The User undertakes to comply with all the requirements of the documents governing the terms of use of the respective services and the terms and conditions of providing the Subscription, Advanced Privileges, Additional options.

4.7. If the User has been granted access to the Subscription and/or Additional option without making, and/or paying for, the Subscription and/or Additional option, the User confirms his or her consent with these Terms and Conditions by performing actions aimed at gaining remote access to the Content and/or Benefits under the Subscription and/or Additional option.

The User cannot be provided with the ability to access the Subscription and/or Additional option without independently issuing and / or paying for the Subscription and/or Additional option on condition of linking bank card in case of linking the same bank card more than once (even if this bank card is linked to different accounts). In addition, Yandex reserves the right at its sole discretion to refuse access to the Subscription and/or Additional option without independently registering and / or paying for the Subscription and/or Additional option in the case of linking a virtual or prepaid bank card.

If the User is granted access to the Subscription and/or Additional option without charging the Subscription fee/ Additional option fee, and the User has not performed any actions aimed at obtaining remote access to the Content and/or Benefits and/or Additional option during the Subscription period/ Additional option Subscription Period, and/or is not a User of the Advanced Yandex Plus Subscription, and/or is not a member of the Yandex Plus Cashback Loyalty Program (https://yandex.ru/legal/plus_loyalty), Yandex may treat as the User's refusal to renew the Subscription and/or Additional option from the date of termination of the free Subscription Period.

If the User is provided access to the Subscription without charging the Subscription, but with the condition of paid renewal of the Subscription from the date of termination of the free Subscription Period, the User may refuse to renew the Subscription by contacting the support service via the feedback form at: https://yandex.ru/support/passport, or in the Personal Account, but this option may be available no earlier than seven days before the expiration of the free Subscription Period.

4.8. Yandex shall take all reasonable measures and any appropriate steps to maintain the efficiency of Yandex.Music Service, Kinopoisk Service and Yandex (its affiliates') services that grant remote access to the Content and the Benefits, Advanced Privileges, Additional options. The User is aware that the said services may experience technical faults and failures and agrees that Yandex is technically incapable to predict, to notify the User of, or to fully exclude such faults and failures. Regardless of reasons and consequences, such faults or failures may not be grounds for sanctions against Yandex.

4.9. Yandex shall not be held liable under disputes and disagreements arising between the User and Yandex Plus Content and Benefits program partners under the Subscriptions, Advanced Yandex Plus Subscription, Additional options, unless such disputes originate from violations of obligations by Yandex under contracts with its partners.

4.10. Any questions and claims related to the Contract shall be sent via the feedback form at: https://yandex.ru/support/passport

4.11. Yandex may, if it so decides, involve third parties to exercise its rights and duties under these Terms and Conditions.

4.12. These Terms and Conditions and all relations associated with the Subscription, Advanced Yandex Plus Subscription, Additional options shall be subject to the laws of the Russian Federation and any claims or actions arising out of or in connection with these Terms and Conditions shall be submitted to, and reviewed by, courts at Yandex location.

4.13. Where stipulated by the applicable laws, when the Subscription, Additional option is being paid for by the User, a cash voucher is sent to the e-mail address specified by the User in the Personal Account. Besides that, when payment for the Subscription is calculated in the currency of the User’s country, the cost of the Subscription is specified in the check in Russian rubles at the exchange rate of the Central Bank as of the settlement date. As provided by the applicable laws, when making payments for Advanced Yandex Plus Subscription, a sales receipt is sent in the manner provided by clause 3.1.2 of the document Terms of Use of Yandex.Taxi (https://yandex.ru/legal/taxi_termsofuse).

4.14. Only one of the Yandex Plus World of Tanks Basic, Yandex Plus World of Tanks Standard or Yandex Plus World of Tanks Maximum Subscriptions may be active at a time (hereinafter referred to as Yandex Plus World of Tanks Subscriptions). The User may at any time activate a more expensive Yandex Plus World of Tanks subscription. At the same time, the current Yandex Plus World of Tanks Subscription will be suspended until the termination of the new Yandex Plus World of Tanks Subscription.

If a User already has a an active Yandex Plus Subscription (except for the Yandex Plus included Subscription or Yandex Plus Subscription purchased through the App Store or Google Play) at the time the Yandex Plus World of Tanks Subscription is activated, the first may be suspended until the end of the Yandex Plus World of Tanks Subscription Period. The Yandex Plus World of Tanks Subscriptions may be active simultaneously with Yandex Plus Subscription purchased through the App Store or Google Play, and other Yandex Plus included Subscriptions, not specified in the present paragraph and which do not belong to Yandex Plus World of Tanks Subscriptions.

4.14.1. The access to the specified set of Non-activated data and Commands is granted to the User each time a new Yandex Plus World of Tanks Subscription is activated. At the same time, access to previously received sets of Non-activated data and Commands within any Yandex Plus World of Tanks Subscription is maintained in accordance with the present Terms simultaneously with the access to a set of Non-activated data and Commands within a new Yandex Plus World of Tanks Subscription.

4.14.2. A User activating the Yandex Plus World of Tanks Subscription for the first time ever, provided that at the time of such an activation the User does not have an active Yandex Plus Subscription (or other Subscriptions that include it, except for Yandex Plus World of Tanks Group Subscriptions) and has never previously activated Yandex Plus World of Tanks Subscriptions, may be granted with a bonus set of Non-activated data and commands (hereinafter referred to as the "Starting Bonus"). Additional conditions of the Starting Bonus obtaining and its contents are described on https://plus.yandex.ru/wot.

4.15. Any set of Non-activated data and commands provided to the User within the Yandex Plus World of Tanks Subscriptions, including the Starting Bonus, can be changed unilaterally by the decision of WARGAMING at any time. Information about the current sets of inactive data and commands, including their composition, is available on the page https://plus.yandex.ru/wot.

4.15.1. If changes are made to the sets of inactive data and commands within the Yandex Plus World of Tanks Subscriptions by these Terms, new sets of inactive data and commands are provided to the User only starting from the Subscription Period that began to take effect after the entry into force of the relevant changes made in accordance with clause 1.3. of the Terms.

4.16. In-Game non-activated data and commands are provided only if the User after purchasing a Yandex Plus World of Tanks Subscription would link a Wargaming.net account to the Yandex Plus World of Tanks Subscription via http://plus.yandex.ru/wot. A Wargaming.net account must belong to the CIS Game region (ru.wargaming.net). Non-activated data and commands will be credited to the linked Game account. A Game account cannot be linked to more than one Yandex Plus World of Tanks Subscription at the same time.

4.17. In order to gain access to a set of Non-activated data and Commands provided within a Yandex Plus World of Tanks Subscriptions a User must login in the Game via the linked account after the start of the Yandex Plus World of Tanks Subscription Period. If the User has not made such a login within a month from the beginning of the Subscription Period (including for the reasons of his account being blocked), the User may only utilize the elements of appearance and the crew members (if they are provided by the according Subscription), but the other Non-activated data and Commands for this Subscription Period become unavailable.

4.18. When using the Non-activated data and Commands provided within the Yandex Plus World of Tanks Subscriptions, including the Starting Bonus, the User is obliged to comply with the WARGAMING License Agreement posted at https://legal.ru.wargaming.net/ru/eula (hereinafter referred to as the License Agreement). The User is deprived of the opportunity to use the Non-activated data and Commands if the linked Game account is deleted, temporarily or permanently blocked by WARGAMING due to violation of the License Agreement, or for other reasons provided for in the License Agreement. Whether the account is unblocked, provided that such an opportunity is enlisted in the License Agreement, the ability to use the Non-activated data and Commands is restored within the Subscription Period, subject to the restrictions provided for in these Terms, including clause 4.17.

4.19. Questions related to the functioning of Non-activated data and Commands provided in the Game should be directed to the WARGAMING support service.
